Embedding ACF Custom Fields in a Plugin

I’ve been using ACF repeater fields to create a jQuery Slider, eventually I want to turn it into my first plugin…

Am i right in thinking that the register_field_group() function requires ACF to be installed?

If so, am I allowed to include ACF Pro in the plugin?? Or can I just include the relevant repeater field code?
