Customized and use for my theme?

I am a theme developer and I like ACF plugin as everybody does. can I customize this plugin and add on my directory theme? we have not built yet but we are looking for a plugin for custom fileds.
we can make it like acf-[theme-name] version and add it on our theme.
Can I do that?

Our client maybe download only free version first. but they might buy addon.
