Issue with conditional logic and obrigatory fields

In v3.5.6.3 :
Obrigatory fields which should apear only when another field is checked, are still preventing page to update even when the conditional field is NOT checked!
For example:
[ ] Should field 'foo' appear ?
If it's not checked but 'foo' is an obrigatory field I cannot reload the page even when it's not showing because it throws the message that the validation failed.
This wasn't happening in the previous version I had (v3.5.3.1)
